Terms of Service
Effective Date: September 10, 2026 | Last updated: September 10, 2026
These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("Client", "User", "you", or "your") and CNC Web Growth("we", "us", or "our", operating at cncwebgrowth.com).
These Terms govern your access to and use of our website, our complimentary website audits and roadmap reviews, strategy consultations, and professional custom web design, RFQ architecture, and consulting services tailored for CNC machine shops and precision contract manufacturers.
By browsing our website, submitting an audit request, scheduling an appointment via Cal.com, or executing a project Statement of Work (SOW), you confirm that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
1. Eligibility & Commercial Scope
Our web property and services are exclusively designed for commercial B2B entities, precision machine shops, fabrication facilities, and industrial manufacturing professionals. By using our website or requesting services, you represent and warrant that:
- You are at least 18 years of age and possess the legal capacity to enter into a binding contract;
- You are acting on behalf of a legitimate business enterprise, corporation, partnership, or sole proprietorship;
- All information you submit regarding your company, machine capabilities, and contact details is truthful, accurate, and current.
2. Free Website Audits, Roadmaps & Discovery Calls
We offer complimentary website audits, digital positioning roadmaps, and 30-minute discovery sessions to help manufacturing leaders evaluate their current RFQ conversion performance.
ℹ️ Evaluative & Consultative Nature:
Requesting a free audit or scheduling a strategy call is entirely without obligation and does not establish a formal agency-client contract or professional engagement. All audit reviews, benchmark analyses, and roadmap suggestions are provided for informational, evaluative, and educational purposes only.
3. Professional Client Engagements & Statements of Work
A formal professional service engagement begins exclusively upon the mutual execution of a written proposal or Statement of Work (SOW) signed by authorized representatives of both parties. In each engagement:
- Transparent Fixed Pricing: Every custom website build and RFQ system architecture project is scoped with a clear, transparent fixed fee. We do not bill surprise hourly overages or unexpected administrative fees.
- Milestone Deliverables:Projects proceed through defined milestones (e.g., Strategic Positioning & Wireframing, Interactive Prototype & Technical Copywriting, Engineering & CMS Integration, Staging Quality Assurance & Go-Live).
- Client Cooperation: Timely project completion requires mutual cooperation, including timely delivery of equipment specifications, tolerance capabilities, materials machined, high-resolution facility photos, certifications (e.g. ISO 9001, AS9100), and design review feedback.
4. 100% Intellectual Property Ownership Handover
We believe machine shop owners should own their digital assets without vendor lock-in or hostage licensing fees:
- Full Client Ownership: Upon receipt of full and final payment under an executed SOW, you retain 100% exclusive ownership of your completed website, custom source code, written technical copy, digital graphic assets, and custom RFQ form configurations.
- No Proprietary Lock-In: We build using open, modern web standards (e.g., Next.js, standard cloud hosting). We do not force you onto closed proprietary site-builder platforms or charge recurring licensing fees to access your own code.
- Agency Background Tools: CNC Web Growth retains ownership of its pre-existing design frameworks, internal software toolkits, and general development methodologies developed prior to or independently of the client engagement.
5. Manufacturing Confidentiality, CAD Files & NDAs
We recognize that precision contract manufacturers operate under strict customer confidentiality requirements, non-disclosure agreements (NDAs), and sensitive commercial relationships (including aerospace, defense, medical, and energy projects).
Any proprietary machine lists, equipment tolerances, customer case parameters, or CAD/CAM technical drawings shared with us during an audit, roadmap consultation, or client project are held in strict commercial confidence. We are pleased to execute mutual Non-Disclosure Agreements (NDAs) prior to accessing proprietary client data.
6. Truth in Advertising & Commercial Results Disclaimer
In compliance with Google Ads policies, FTC guidelines, and standard commercial laws:
- We engineer high-performance websites and RFQ architectures specifically calibrated around how technical buyers, procurement managers, and design engineers evaluate machining partners.
- However, because incoming RFQ volumes, contract awards, and closing rates depend on external commercial factors—such as your shop's pricing competitiveness, machine capacity, material lead times, sales follow-up velocity, and broader macroeconomic conditions—CNC Web Growth cannot and does not guarantee specific revenue levels, contract award values, or numeric RFQ volumes.
- Any case studies, client results, or testimonials featured on our website represent authentic experiences of specific manufacturers and should not be construed as a promise or guarantee of identical outcomes.
7. Permitted Use & Prohibited Conduct
You agree to use our website only for lawful business purposes. You agree that you will not:
- Use automated systems, bots, spiders, or scrapers to harvest data, text, or graphics from our website without written permission;
- Attempt to compromise the security, integrity, or availability of our servers, networks, or connected databases;
- Introduce viruses, malware, trojans, worms, or other technologically malicious materials;
- Submit false, fraudulent, defamatory, or deceptive information through our audit inquiry forms or appointment scheduler;
- Use our website or branding to transmit unauthorized spam or commercial solicitations.

9. Disclaimer of Warranties
Except as expressly set forth in a fully executed Statement of Work, our website, free audits, digital roadmaps, and all materials are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied.
To the maximum extent permitted by applicable law, CNC Web Growth disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular manufacturing or commercial purpose, non-infringement, and error-free operation.
10. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall CNC Web Growth, its owners, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages—including but not limited to loss of profits, loss of revenue, loss of data, machine downtime, or business interruption—arising out of or related to your use of this website, our audit roadmaps, or any services provided.
To the maximum extent permitted by law, CNC Web Growth's total aggregate liability arising out of or related to these Terms, our website, or any client engagement shall be strictly limited to the total fees paid by you to CNC Web Growth for the specific service giving rise to the claim in the twelve (12) months preceding the incident.
11. Indemnification
You agree to defend, indemnify, and hold harmless CNC Web Growth, its officers, contractors, and affiliates from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) any materials, CAD files, or content you supply to us; or (c) your violation of any third-party rights, including intellectual property or non-disclosure obligations.
12. Informal Dispute Resolution & Governing Law
We pride ourselves on high-touch, long-term partnerships with precision manufacturers. In the event of any disagreement:
- Informal Negotiation: The parties agree to first attempt in good faith to resolve any dispute, claim, or controversy informally through direct executive consultation for a minimum of thirty (30) business days before initiating formal legal proceedings.
- Severability: If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of any remaining provisions.
- Entire Agreement: These Terms and any mutually executed Statement of Work constitute the entire agreement between you and CNC Web Growth regarding your use of our website and services.
13. Modifications to Terms
We reserve the right to revise or update these Terms periodically to reflect operational, legal, or regulatory updates. Any changes will take effect immediately upon posting to this page. Continued use of our website following the posting of revised Terms signifies your acceptance of the revisions.
